Settlement and Negotiation
Frequently, personal injury cases are settled through negotiations with the at-fault party's liability insurance carrier. Settling a case may be in your best interest and most cases settle. Still, typically it takes months for an injured person to heal sufficiently before settlement value may be properly assessed. Each case is unique. Significant skill is required to develop a case properly before settlement value can be gauged.
It is not unusual for an insurance company to pressure premature settlement.
Often, I prepare for trial before a settlement is reached. Whenever an offer is on the table, I will know as much as possible about your case and therefore can advise you on the best decision to make. Some cases simply cannot settle and must go to arbitration or trial. No two cases are alike and each case takes its own path.
